Terms and Conditions
General Terms and Conditions of Big Al’s AG.
1) Scope
These General Terms and Conditions apply to all services provided by Big Al’s AG in its capacity as a carrier and/or warehouse keeper. Any special agreements or deviations from these General Terms and Conditions are only valid if they have been accepted in writing by Big Al’s AG.
2) Liability
Big Al’s AG shall be liable for any damage or loss demonstrably caused, whether by itself or its agents, through wilful misconduct or gross negligence, from the time the goods are taken into its care until their delivery. Liability for simple negligence is excluded.
3) Exclusions of Liability
Big Al’s AG shall not be liable in the following cases:

for damage caused by force majeure such as war, earthquakes, looting, destruction or civil unrest.

for damage caused through the fault of the client, sender, recipient or their vicarious agents. for breakage resulting from normal vibrations.

for damage resulting from defective or unsuitable packaging.

for damage to or shortage of goods transported in sealed or externally undamaged crates, boxes or containers, the perfect condition and completeness of which could not be checked upon acceptance.

Big Al’s AG shall not be liable for consequential or financial losses that may arise as a result of loss or damage.
4) Limit on liability
Big Al’s AG’s liability as a carrier and warehouse keeper in respect of any goods carried or stored is limited to their actual cash value, up to a maximum of 8.33 Special Drawing Rights per kilogram of gross weight of the relevant part of the consignment. The maximum liability per incident is 20,000 Special Drawing Rights in total.
5) Insurance
Any transport insurance (cargo insurance) or insurance against risks relating to goods handed over for storage (theft, water damage, fire, natural disasters, etc.) is the sole responsibility of the client.
6) Jurisdiction
All disputes arising from contracts governed by these terms and conditions shall be subject to Swiss law. The place of jurisdiction shall be the registered office of Big Al’s AG.
